Action in the district court for Polk county to recover $1,000 upon a life insurance policy. The case ivas tried before Watts, J., and a jury which returned a verdict favor of plaintiff for the amount of the policy. Erom an order denying defendant’s motion to set aside the verdict and for a new trial, it appéaled.

Action to recover upon a policy of insurance issued by defendant upon the life of plaintiff’s husband, Arvid Peterson.' Plaintiff had a verdict in the court below, and defendant appealed from an order denying its motion for a new trial.

The policy of insurance contained the provision that if, within one year from the date thereof, the insured “shall die by suicide, whether sane or insane, * * * the liability of the company shall not exceed the amount of the premiums paid on this policy.” The *233insured died within a year, and the defense to the action was that he committed suicide while laboring…
