ORDER ON RECONSIDERATION

CASELLAS, District Judge.

Pending before the Court is Plaintiffs— Goya de Puerto Rico, Inc., (“Goya”) — “Motion to Amend Judgment under Fed. R.Civ.P. 59(e).” (Docket # 35). 1 For the reasons stated below, Plaintiffs motion is DENIED.

I. Background

On April 25, 2000 this Court entered an order granting a motion to dismiss filed by co-defendants Miguel O. Muñoz-Muñoz and Andrés Rosado-Padilla, (hereinafter “Co-defendants”), whereby the Court found that the case of Goya De Puerto Rico, Inc. v.
