Appeal from a judgment of the Herkimer County Court (Patrick L. Kirk, J.), rendered August 31, 2005. The judgment convicted defendant, upon a jury verdict, of burglary in the *1320second degree, criminal mischief in the fourth degree (two counts) and petit larceny.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
