This suit was instituted by the Southern Trading Company of Texas against W. W. Hancock and the San Antonio Lumber & Tie Company upon two promissory notes in the sum of $125 each that had been executed by W. W. Hancock, and the payment of which it was alleged had been assumed by the tie company, á copartnership composed of J. M. Dobie, Joe L. Hill, and W. A. Frisby. The plaintiff also sought to foreclose a lien upon a certain steam engine and fixtures and smoke stack which had been given to secure the notes.
