(specially concurring). I concur in the conclusion and result of the decision rendered in the present case, but I am of the belief that the opinion should contain a more thorough discussion of the issues involved than is presented in the majority view.

The appellant raises certain fundamental questions based upon alleged errors which have been adequately preserved for review by this court, and these questions, if decided in its favor, would entitle it not only to a reversal of the trial court’s order overruling its motion for a new trial, but would warrant a reversal of the judgment and a…
