MEMORANDUM AND ORDER

LOVELL, District Judge.

On April 18, 1984, an indictment was filed charging the above named defendants with income tax evasion, in violation of 26 U.S.C. § 7201, and with conspiracy to defraud the United States government, in violation of 18 U.S.C. § 371. Subsequently a plea agreement was reached, by the terms of which defendant Edward Messer agreed to plead guilty to one count of tax evasion in return for dismissal of the other charges against him, and the government agreed to dismiss the indictment against defendant Karen McKenna Messer and to file an amended information…
