Appeal from an order of the Family Court of Delaware County (Becker, J.), entered April 1, 2013, which granted petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.
The parties are the parents of a daughter (born in 1999) and a son (born in 2001). In 2009, Family Court awarded respondent (hereinafter the father) sole custody of the children, with visitation to petitioner (hereinafter the mother), and this Court affirmed upon appeal (Matter of Kowatch v Johnson, 68 AD3d 1493 [2009], lv denied 14 NY3d 704 [2010]).
