B. Britt was indicted for the murder of Ed Andrew on June 21, 1923. There was a verdict of murder in the first degree with recommendation to mercy.

The defendant and his wife were living in a tent on Treasure Island, near Midnight Pass, in Sarasota County. On the morning of the 21st of June, H. A. Davidson, who *484lived on the island, in company with Ben Robinson, went to the beach, a place where they usually caught bait for fishing.
