The appellant is a private corporation [city of Corsicana, Tex. It instituted this suit in the court below against the appellee to recover a balance of $583.60 due on a I promissory note and $125.90 due on an open account. It also asked for the foreclosure of a chattel mortgage on some personal property given to secure the payment of the note. Among other defenses the appellee pleaded payment, and • also asked for judgment against the appellant for an excess of $400.44 which he claims to have paid on other indebtedness held by the appellant.
