TALBOT, Associate Justice.

Appellee was indebted to appellant on open account, for goods, wares and merchandise, in the sum of $3548.40. In November, 1901, he was in failing circumstances and informed appellant of that fact. > In view of appellee’s statements of his financial condition and that he would be forced into bankruptcy proceedings, if he could not compromise and settle said account, appellant agreed to and did accept, in full payment and satisfaction thereof, the sum of $1500.
