Reversing.

These two appeals have been heard together, and will be considered in one opinion.

The facts are these: In the month of May, 1929, J. R. Laster was elected trustee of common school sub-district No. 31, in Muhlenberg county, to serve until the first Saturday in May, 1931. On December 23, 1930, Laster recommended in writing for the position of teacher in subdistrict No. 31 Chester Weatherford, who was then engaged in teaching in that district.
