OPINION

HUMPHREYS, Justice.

The Commissioner appealed from a judgment of the Third Circuit Court of David son County, reversing his order that petitioner Harold Lewis Totty, Jr.’s automobile be confiscated for the transportation of marijuana. We reverse the Third Circuit Court, and reinstate the order of the Commissioner.
