OTIS, District Judge.

This ease has had a long history. Originally, on May 2,1924, it was filed as an action at law. Thereafter, on proper motion, it was transferred to the equity docket, and a bill of complaint in equity was substituted for the original petition at law. A motion to dismiss the bill for want of equity was filed by the defendants, or some of them, and was sustained by this court. Prom the order dismissing the bill, the plaintiff appealed.
