This appeal is prosecuted by the complainant in a bill for partition filed in the circuit court of Logan county from a judgment of the Appellate Court affirming the decree of the circuit court, and brings in question only the action of the latter court in refusing to tax a solicitor’s fee as costs and apportion it among the parties in interest.
