E. 0. Canterberry brought this suit against his brother, M. 0. Canterberry, and his mother, Clara A. Canterberry, in her own right and as executrix of the will of G. F. Canterberry, deceased, to impeach a paper writing, which, some years previous, had been admitted to probate by the county court of Kanawha County as the last will and testament of, the decedent, plaintiff’s father, and praying for an issue devisavit vel non out of chancery.
