• This is an action brought by the plaintiff against the defendant Flanagan, as sheriff of Chouteau county, and his deputy sheriff, Brundage, to recover damages for the conversion of certain cattle alleged to belong to plaintiff. The complaint alleges the official capacity of the defendants; that on July 14, 1919, plaintiff was the owner of twenty-five head of cattle, of the value of $1,675, and on said date the defendants under a writ of attachment issued out of the district court of Pondera courity, in an action wherein F.
