Defendant, William C. Saulsbury, was charged, under the Nebraska Child Pornography Prevention Act, Neb. Rev. Stat. § 28-1463.01 et seq. (Reissue 1989), with making, publishing, directing, creating, or in any manner generating a visual depiction of sexually explicit conduct which has a child as one of its participants. See § 28-1463.03. Defendant filed a plea in abatement and a motion to quash the pornography charge on the basis that the statute was unconstitutionally vague or, alternatively, did not apply to his conduct.
