MEMORANDUM OF DECISION AND ORDER ON MOTION TO DISMISS CASE

I. INTRODUCTION

In this contested matter the Movant, People’s Bank (hereinafter “People’s”), seeks to have dismissed the pending Chapter 13 case of Alan A. Winder and Ruth Winder (hereinafter “Debtors”) on the basis of the Debtors’ alleged ineligibility for relief under Chapter 13 pursuant to 11 U.S.C. § 109(e).
