The statute authorizes the Superior Court to issue writs of mandamus, and proceed therein and render judgment according to the course of the common law. At common law the party interested in having an act done, made demand to the party upon whom the duty devolved to do the act. Upon his refusal he made application, supported by affidavits, to the court for a rule to show cause why a writ should not issue, which was served upon the defendants.
