HOLMES, Circuit Judge.
This appeal is from a judgment on a verdict for the plaintiff in an action for damages for personal injuries resulting from being struck by an automobile belonging to appellant George D’Allessan-dro, while the same was being operated by appellant Pete D’Allessandro. The points raised are the sufficiency of the declaration, the propriety of the exclusion of certain documentary evidence, and the sufficiency of the evidence to sustain the verdict.
