BLUME, Chief Justice.

In view of my dissenting opinion in Pen-ton v. Canning, 57 Wyo. 390, 118 P.2d 1002, 138 A.L.R. 300, I should, perhaps, add a note. That case has been the law of this state for many years and is binding upon me as well as on everyone else until or unless overruled, and there is no majority of this court willing to do that, and I am not saying that it should be overruled.
