RANDOLPH, Circuit Judge:
The Secretary of the Treasury must authorize the importation of any firearm that is “of a type” “generally recognized as particularly suitable for or readily adaptable to sporting purposes.”' 18 U.S.C. § 925(d)(3). In April 1998, the Secretary announced that modified semiautomatic assault rifles with the ability to accept large capacity military magazines do not satisfy § 925(d)(3), and therefore may not be imported pursuant to that section.
