This action was begun in the district court for Douglas county by Elizabeth E. Shannon and others, to enjoin the collection of certain special assessments levied to pay the expense of filling four lots OAvned by plaintiffs, the city of Omaha having by ordinance declared the lots to be a nuisance, by reason of the accumulation of stagnant water thereon. From a decree rendered dismissing the action for want of equity the plaintiffs prosecute this appeal.
