Plaintiff appeals after the trial court granted summary judgment in favor of defendant State Farm Mutual Automobile Insurance Company (State Farm) on plaintiff’s claims for underinsured motorist (UIM) benefits and personal injury protection (PIP) benefits. ORCP 47. We affirm.
Plaintiff was injured in a multi-car accident in March 2003. Plaintiff’s vehicle was struck from behind by a pickup truck driven by defendant Enrique Quicehuatl; a pickup truck driven by defendant Philip Hulse then rear-ended Quicehuatl’s truck, causing Quicehuatl’s truck to strike plaintiff’s vehicle a second time.1…
