(After stating the foregoing facts.) It is contended by the plaintiffs in error that the court erred in overruling their pleas of res judicata. While no copy of the pleadings or judgment in the former case was set out or attached to the special pleas, it is stated therein that the former suit was one for specific performance, which was an equitable proceeding. The present action is one at law for damages for breach of the contract, an entirely different proceeding.
