This is an appeal from the Board of General Appraisers to the United States Circuit Court for the Southern District of New York, transferred to this court under the provisions of the act of August 5, 1909.

*490The decision of the Board of General Appraisers was rendered upon an agreed statement of facts. From this statement it appears that certain “preserved cherries in maraschino in glass/' or “preserved cherries in glass in maraschino/’ were, during the months of August, September, and October, 1906, imported by James P. Smith & Co., of New York, at that port.
