The parties will be referred to as they appeared in the trial court. The plaintiff sued the defendants for damages upon a claim that, while plaintiff was in the hospital under treatment by defendant Dr. AVm. Leslie and his nurse, Sylvia Flood, chloroform was negligently spilled on the shoulder and arm of plaintiff, blistering them, causing sores and great suffering, and permanently disfiguring her. Summons dated a day before the petition was filed was issued and served on Sylvia Flood, requiring answer April 24, 1932. An alias summons was issued, upon the failure to serve the original summons…
