This action was instituted by the plaintiff to recover the balance due on five promissory notes aggregating approximately $3,000, together with interest, attorney's fees and costs. Three of the notes were executed and delivered by the defendant to the plaintiff as payee, on July 30, 1929, and two of them, in favor of the Minneapolis Threshing Machine Company as payee, dated October 15, 1925, aggregating $987, which were duly indorsed to the plaintiff.
