OPINION

WRIGHT, Judge.

Relator challenges the senior unemployment review judge’s dismissal of his unemployment-benefits appeal as untimely. We affirm in part and reverse in part.

FACTS

In 1995, relator Larry Rowe suffered a viral heart attack that resulted in congestive heart failure. Rowe’s congestive heart failure worsened steadily over the next few years; and in 2002, Rowe was terminated from his job and placed on a waiting list for a heart transplant.
