This was an action on the case, brought by James Anderson, by his next friend, against J. Dietrich Ileimsoth, to recover damages for injuries suffered by the plaintiff from the bite of a dog, which, as he claims, belonged to the defendant. On the 17th day of June,,1882, the date of the injury, the plaintiff, then a child a little over three years old, was playing in an alley near his home, in the city of Chicago, when a dog came through a hole in the fence along the alley and bit him.
