Defendant in error, as administrator of the estate of James J. Morrissey, deceased, filed suit in the superior court of Cook county against the plaintiff in error and the Michigan Central Railway Company for damages by reason of the alleged wrongful death of Morrissey. The declaration charged that Morrissey was fatally injured June 24, 1914, while employed as a switchman for plaintiff in error.
