This case was before this court on a former occasion, when the judgment of the trial court was reversed and the cause remanded. It will be found reported in 13 Bradwell, 516; to which reference is made for a full statement of the case. It will there be seen, that the contest is very close upon the questions as to the liability of the railroad company for the injury received by appellee’s intestate while in its service.
