AINSWORTH, Circuit Judge:
Floyd Featherston, while in federal custody and subject to the District Judge’s order committing him for psychiatric observation to the federal hospital in Springfield, Missouri, petitioned the same District Judge for a writ of habeas corpus on the ground that he was being detained in violation of his federal constitutional right not to be placed twice in jeopardy for the same offense. 28 U.S..C. § 2241(c) (3) (1964); see U.
