Appeal from Black Hawk District Court. — Hon. A. S. Blair, Judge. ^Action at law on a judgment rendered by a district court in tlie state of North. Dakota. At the close of the evidence the plaintiff asked the court to' direct a verdict in her favor, which was done, and a verdict was returned as directed, upon which a judgment was rendered in favor of the plaintiff. The defendant appeals.—

— The defendant is a corporation • organized and existing by virtue of the laws of this state. The plaintiff seeks to recover the amount of a judgment which was rendered by the district court in and for Gass county, in North Dakota. The action in which the judgment was rendered was commenced by the issuing of a summons directed to the defendant,- and served in Oass county upon A. L. Garey, who- is stated in the return of the officer who served the summons to have been “agent, for service of process, of said defendant.” There was no other service of notice of the action, and no- appearance…
