Relator having been taken into custody under a rendition warrant issued by the governor of this state upon the requisition of the governor of Virginia has sued out a writ of habeas corpus. He makes no claim that the proceedings are not regular on their face or that the governor of the state of New York was without jurisdiction to issue the warrant, but urges before me only that he is not a fugitive from justice within the meaning of the federal Constitution and United States Revised Statutes, section 5278, because, as he claims, he was not in the state of Virginia on the particular date laid…
