When this matter was originally submitted to the Court of Appeals 2 Mich App 404 the only issue raised on appeal was whether the proposed use was an illegal invasion of plaintiffs’ property rights as riparian owners abutting Gun Lake. In the view of the panel that considered the case it was not, and accordingly summary judgment was ordered for the defendants.

That decision was reversed on appeal to this Court and the case remanded to the trial court for trial.
