RUSSELL, Circuit Judge.

This appeal is from an order denying an application of appellant, Rogers Henry Porch, a prisoner in custody pursuant to the judgment of a Court of the State of Georgia, for a writ of habeas corpus. Appellant was convicted of the crime of rape and sentenced to be executed. From the denial of a motion for a new trial, appellant sought a review of his conviction by the Supreme Court of Georgia.
