HANSEN, Circuit Judge.

The United States of America appeals the order of the district court granting Alejandro Villalpando’s motion for new trial. We reverse in part and affirm in part.

I

Defendant Alejandro Villalpando was convicted by a jury of drug conspiracy as charged in Count 1 of the indictment and two firearm offenses charged in Counts 3 and 4. The jury acquitted him on a separate charge of drug possession with intent to distribute as alleged in Count 2.
