This case was brought on behalf of several minors (the “Named Plaintiffs” or “Plaintiffs”) in custody of the Rhode Island Department of Children, Youth & Families (“DCYF”), who had been placed into foster care after they were removed from their biological homes following allegations of abuse and/or neglect.2 After the parties engaged in a lengthy discovery process and after settlement negotiations were unfruitful, the Plaintiffs’ case was presented to this Court in the course of a sixteen-day bench trial.
