MEMORANDUM DECISION

MCMAHON, District Judge.

Plaintiff James D. Stalter, Jr. (“Stalter”) sued defendant Board of Cooperative Educational Services of Rockland County (“BOCES”) under the Americans with Disabilities Act (“ADA”) and the New York Executive Law, claiming that BOCES discriminated against him because he had cerebral palsy and could not speak.
