This appeal raises important questions under the Motor Carrier Act of 1980, P.L. 96-296, 49 U.S.C. § 10101, et seq. (the 1980 Act). Reference is made to the opinion in American Tracking Associations, Inc. v. Interstate Commerce Commission, 659 F.2d 452 (5th Cir. 1981), where Judge Alvin B. Rubin set forth in detail a discussion of legislative background and an analysis of the Act.
