Reversing.
The appellee, Joseph Lyons, on February 15, 1910, sold and by deed conveyed to the appellant, C. C. Eaisor, two tracts of land lying on BullsMn creek, in Shelby county, Kentucky, the first tract containing 44.51 acres, excluding a graveyard of an acre, the second containing 40.74 acres. The two tracts lie side by side and both adjoin a tract of 111 acres yet owned by the appellee and upon which he resides.
