SWAIM, Circuit Judge.

This appeal is from a judgment for damages for personal injuries sustained by the plaintiffs, Daniel A. Collins and Alma Collins, his wife, as a result of a collision between the automobile in which the plaintiffs were riding, and which was being driven by Daniel Collins, and a farm tractor driven by the defendant Guy Neal. The complaint alleged as negligence (a) that the defendant negligently, carelessly and improperly operated and drove the tractor, and (b) that the defendant operated the tractor on the highway after sunset and before sunrise without having it equipped…
