This is a suit brought in the municipal court of Omaha *757by William Packer against Snyder, Malone, Coffman Company, Inc., for an alleged conversion of eight head of cattle. Verdict and judgment were set aside by trial judge, and case dismissed on his own motion.

The defendant corporation was a live stock commission firm, doing business at the Union Stockyards in Omaha. The answer was a general denial.
