This is an action by the trustee under the will of Edward N. Weber, deceased, to recover $8111.05, alleged to be due the estate of the testator. The cause was tried before the court without a jury. The finding and judgment went for defendant and plaintiff appealed.

The defendant grocery company is a corporation organized in 1900, and was owned by Edward N. and John F. Weber, brothers. Edward N.
