Plaintiff filed a complaint for the wrongful death of Joseph Guido Flaim, alleging that the defendants, drivers of two automobiles involved in a drag race, were negligent, and asking jointly and severally for damages in the sum of $300,000. Defendants answered, claiming they were not negligent and that Flaim was contributorily negligent, such negligence being the proximate cause of the accident. The matter was tried to a jury which found for the defendants and against the plaintiff.
