WAHL, Justice.
Appeal from an order of the Hennepin County District Court, which dismissed the instant action on the ground that plaintiff’s presentation of evidence failed to establish a right to relief. We reverse.
Plaintiff Steven Paradise commenced this assault and battery action to recover damages for injuries he allegedly sustained on July 16, 1976, when he was arrested for disorderly conduct by two Minneapolis policemen.
