In October, 1935, the plaintiff, a New Hampshire corporation, and defendant entered into an agreement by the terms of which the plaintiff was to finance loans placed by the defendant. The defendant was to investigate the borrowers, 'make out the necessary papers including the notes and mortgages securing the loans, attend to collections, report weekly on same, and remit weekly such collections as he had received less his commission which was agreed to be 5%. The defendant at the time this agreement was made was operating a finance business in Rutland under the name of the Eastern Finance…
