MEMORANDUM OPINION AND ORDER

JOSEPH H. YOUNG, District Judge.

This action has been brought by the plaintiff, James H. Love, in an attempt to prevent his discharge from the United States Naval Academy [“USNA”]. This Court originally issued a temporary restraining order on Jknuary 15, 1981, preventing the defendants from separating the plaintiff from the USNA and assigning him to further military duty.
