—Judgment unanimously reversed on the law and facts and new trial granted. Memorandum: Defendant appeals from a judgment convicting him of criminal sale of a controlled substance in the third degree. The People conceded that a reconstruction hearing was required to determine whether defendant was present at a Sandoval hearing at which County Court concluded that defendant could be asked on cross-examination if he had ever been convicted of a crime (People v James, 207 AD2d 1028).
